TERMS AND CONDITIONS OF COOL GUYS BV

Article 1 Definitions

1.1 In these General Terms and Conditions, the following terms shall have the following meanings:

General Terms and Conditions: these terms and conditions. Cool Guys BV: the company located at Hoefslag 17A, 4131ME Vianen, the Netherlands, registered with the Chamber of Commerce under number 96969768.

Consumer: any natural person who is not acting in the course of a profession or business and who enters into an agreement with Cool Guys BV.

Customer: any natural person or legal entity who enters into an agreement with Cool Guys BV.

Agreement: any agreement between Cool Guys BV and the customer to which these terms and conditions apply.

Website: the website of Cool Guys BV, accessible via www.cool-guys.nl and associated subdomains.

Article 2 Applicability of General Terms and Conditions

2.1 These General Terms and Conditions apply to all offers and agreements of Cool Guys BV, unless otherwise agreed in writing.

2.2 Any terms and conditions of the customer that deviate from these are only binding if they have been accepted in writing by Cool Guys BV.

2.3 If additional terms and conditions apply, the customer may, in the event of a conflict, rely on the provision that is most favourable to them.

Article 3 Prices and information

3.1 All prices quoted are exclusive of VAT and other charges, unless otherwise stated.

3.2 Any additional costs will be clearly stated prior to the conclusion of the agreement.

3.3 The website has been compiled with care, but may contain inaccuracies. Cool Guys BV is not bound by obvious errors.

3.4 Differences in colour display caused by monitors are beyond the responsibility of Cool Guys BV.

Article 4 Formation of the agreement

4.1 The agreement is formed when the customer accepts the offer and meets the conditions.

4.2 In the case of electronic acceptance, receipt will be confirmed as soon as possible. Until that point, a consumer may withdraw from the agreement.

4.3 In the event of incorrect details, Cool Guys BV may suspend performance.

4.4 Cool Guys BV may check whether the customer is able to meet payment obligations and may, on that basis, refuse an order or impose conditions.

Article 5 Performance of the agreement

5.1 Products will be dispatched as soon as possible after receipt of the order.

5.2 Cool Guys BV may engage third parties in the performance of the agreement.

5.3 Delivery will take place within the agreed period or within 30 days at the latest.

5.4 The customer is advised to check the products upon receipt.

5.5 The risk passes to the customer upon delivery.

5.6 If a product is unavailable, an equivalent product may be supplied.

Article 6 Right of withdrawal

6.1 The right of withdrawal applies only to consumers.

Consumers may withdraw from the contract within 14 days without giving any reason.

The period begins upon receipt of the product.

The consumer must notify us in good time.

Payments will be refunded following withdrawal.

Return costs are borne by the consumer.

Any reduction in value may be offset.

Exceptions apply to, amongst other things, custom-made products.

Article 7 Payment

7.1 Payment must be made via the methods offered within the specified period.

7.2 Interest and collection costs are payable in the event of late payment.

Article 8 Warranty and Conformity

8.1 Products comply with the agreement and statutory requirements.

8.2 Warranties do not affect statutory rights.

8.3 Complaints must be reported in good time.

8.4 A suitable solution will be offered in the event of justified complaints.

8.5 Statutory rights remain applicable.

Article 9 Complaints Procedure

9.1 Complaints may be submitted to Cool Guys BV.

9.2 A response will be provided within 14 days.

9.3 European consumers may use the ODR platform.

Article 10 Liability

10.1 Applies to business customers.

10.2 Liability is limited to the invoice amount, subject to a maximum.

10.3 Indirect damage is excluded.

10.4 Exceptions apply in cases of wilful misconduct or personal injury.

10.5 Liability arises following a notice of default.

10.6 Damage must be reported in good time.

10.7 Force majeure excludes liability.

Article 11 Retention of title

11.1 Products remain the property of the seller until full payment has been made.

11.2 This also applies to other claims.

Article 12 Final provisions

12.1 Dutch law applies.

12.2 Disputes shall be submitted to the competent court.

12.3 Invalid provisions shall not affect the remainder.

12.4 ‘In writing’ shall also be understood to mean electronic communication.

Article 13 Model withdrawal form
